General terms and conditions (as of 02.01.2020)

§ 1. General
These general terms and conditions apply exclusively to all contracts between the seller and the customer. We do not recognize any deviating conditions of the customer.

§ 2 conclusion of contract
1. The contract is concluded with the customer in that the customer sends the order he entered in the online shop by selecting the “Buy” button as an offer to conclude a purchase contract and the seller then accepts the customer’s offer by delivery within a reasonable time ,
2. The seller reserves the right not to accept the respective offer, in particular in the event that the online shop contains typing, printing or calculation errors that have become the basis of the customer’s offer, and in the event of interim price adjustments by the suppliers.

3. The language available for the conclusion of the contract is German. The contract text (terms and conditions with the customer’s individual order data) is not saved by the seller after the contract is concluded and is therefore not accessible to the customer.

§ 3 Delivery of the goods / provision for download
1. The goods are handed over in the shipping variant by delivery to the delivery address specified by the customer. Any resulting shipping costs will be shown to the customer in the online shop before the order is completed. For deliveries abroad, the customer has to bear any additional taxes and customs duties that may apply. In the pick-up variant, the goods are handed over to the bookstore in the shop.

2. Software, eBooks and audio files are available for data download after acquisition of the right of use.

3. The seller may use files, information or other data (eg customer’s own data) stored by the customer insofar as this is necessary for the establishment, implementation or termination of the business relationship with the customer, which in particular also requires the production of corresponding copies and their use Backup purposes.

§ 4 prices, terms of payment, retention of title and payment processing
1. All prices stated in the online shop include the statutory VAT.

2. The customer has the choice between the payment methods offered during the ordering process. If the customer chooses the direct debit procedure offered to him, he must issue the necessary SEPA direct debit mandate and ensure that the bank account is sufficiently covered when it is due. In the case of orders executed against direct debit, the customer will receive a prenotification in the invoice sent by email about the impending debit of the bank account. The advance notice is given in good time so that there is a bank working day between it and the debit. In the event of the return or non-payment of a direct debit, the customer irrevocably authorizes the bank to conclude the contract with the seller’s name and current address. Processing fees for the unauthorized return or non-redemption of a direct debit, which are charged to the seller by the seller’s bank, are to be reimbursed by the customer.

3. Standard items delivered to the customer as part of the shipping option remain the property of the seller until they have been paid for in full. In the case of a data download, the right of use is granted subject to the full settlement of all claims against the customer arising from the order.

§ 5 Requirements for the use of eBooks and audio files
1. The seller does not provide the customer with ownership of Pdf, eBooks and audio files. The customer acquires a simple, non-transferable, revocable right to use the offered title for personal use before the full payment of the agreed remuneration.

2. The content of Pdf, eBooks and audio files may not be changed by the customer, subject to deviating mandatory legal rules, neither in content nor in editorial terms.

3. The customer may only copy Pdf, eBooks and audio files for his own personal use or have them copied by a third party for this purpose, provided that the third party creates the copy free of charge. Passing on PDF, eBooks and audio files to third parties (including friends, relatives, acquaintances, etc.) is only permitted temporarily for the purpose of making such a copy; otherwise, disclosure is not permitted, as is its public access or forwarding, its posting against the Internet or other network media, against payment or free of charge, its resale and / or any other type of use for commercial purposes. Photocopying of notes is prohibited.

§ 6 right of withdrawal
In the case of contracts for the delivery of articles, the customer has the following right of withdrawal from the seller:

Consequences of cancellation

If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We can refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired. We bear the cost of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functionality of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not exist for contracts for the delivery of goods that are – not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer or
– can spoil quickly or whose expiration date would quickly be exceeded. The right of withdrawal expires prematurely for contracts for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.

§ 8 Warranty and liability of the seller / bookstore
1. Subject to the following paragraphs 2 to 4, the customer is entitled to the statutory warranty claims.

2. Claims by the customer for damages are excluded. This does not include claims for damages on the part of the customer from injury to life, limb, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages resulting from an intentional or grossly negligent breach of duty by the seller / bookshop or its legal representatives or vicarious agents. Significant contractual obligations are those the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the customer can regularly rely.

3. In the event of a breach of essential contractual obligations, the seller / the bookshop is only liable for the foreseeable damage typical for the contract if this was simply caused by negligence, unless the customer claims for damages from injury to life, limb or health ,

4. The restrictions in paragraphs 2 and 3 also apply in favor of the legal representatives and vicarious agents of the seller / bookshop if claims are made directly against them.

5. The provisions of the Product Liability Act remain unaffected, as well as any claims from a guarantee given by the seller / bookstore or a third party for the quality of the item or for the item to retain a specific quality for a certain period.

§ 9 data protection
1. The customer authorizes the seller and the bookstore to process, save, evaluate and use the customer’s data received in connection with the business relationship in accordance with data protection laws.

2. The customer has a right to information as well as a right to correction, blocking and deletion of his stored data.

3. The customer receives detailed information on the type and scope of data storage of personal data under the heading “Data protection” (see also footer of the website).

4. For the purpose of the credit check, a suitable credit agency will provide the seller with the address and creditworthiness data, including those determined on the basis of mathematical-statistical methods, stored in its database, provided the seller believes its legitimate interest has set out. For the purpose of deciding on the establishment, implementation or termination of the contractual relationship, the seller collects or uses probability values, the calculation of which includes address data, among other things.

5. The seller uses the customer’s email address to send him the seller’s newsletter – if the customer has subscribed to it – and for informational letters that contain current information about the shop offers, services, special offers and promotions of the seller , If the customer no longer wants to receive the newsletter or this information letter, they can unsubscribe at any time – via a link integrated in the corresponding email and also by email to the address reich@fmscore.de.

§ 10 other
German law applies to the exclusion of the UN purchase law. This does not affect the mandatory provisions of the state in which the customer is habitually resident. Both the seller and the bookstore are not obliged and unwilling to participate in dispute settlement procedures before a consumer arbitration board.

Allgemeine Geschäftsbedingungen (Stand 12.6.2019)
§ 1 Allgemeines

Für sämtliche Verträge zwischen dem Verkäufer und dem Kunden gelten ausschließlich diese Allgemeinen Geschäftsbedingungen. Davon abweichende Bedingungen des Kunden erkennen wir nicht an.

§ 2 Vertragsschluss

1. Der Vertragsschluss mit dem Kunden erfolgt dadurch, dass der Kunde die von ihm im Onlineshop eingegebene Bestellung durch Auswahl der Schaltfläche “Kaufen” als Angebot auf Abschluss eines Kaufvertrages an den Verkäufer schickt und dieser das Angebot des Kunden daraufhin durch Lieferung innerhalb angemessener Zeit annimmt.
2. Der Verkäufer bejhält sich die Nicht-Annahme des jeweiligen Angebotes insbesondere für den Fall vor, dass im Onlineshop Schreib-, Druck- oder Rechenfehler enthalten sind, die Grundlage des Angebotes des Kunden geworden sind, und für den Fall zwischenzeitlicher Preisanpassungen der Lieferanten.

3. Die für den Vertragsschluss zur Verfügung stehende Sprache ist Deutsch. Der Vertragstext (AGB mit individuellen Bestelldaten des Kunden) wird nach dem Vertragsschluss durch den Verkäufer nicht gespeichert, ist dem Kunden also nicht zugänglich.

§ 3 Übergabe der Ware / Bereitstellung zum Download

1. Die Übergabe der Ware erfolgt in der Versandvariante durch Lieferung an die vom Kunden angegebene Lieferadresse. Hierdurch ggf. anfallende Versandkosten werden dem Kunden noch vor Abschluss der Bestellung im Onlineshop angezeigt. Bei Lieferungen in das Ausland hat der Kunde ggf. anfallende zusätzliche Steuern und Zölle zu tragen. In der Abholvariante wird die Ware im Ladenlokal der Buchhandlung übergeben.

2. Software, eBooks und Audiodateien stehen nach dem Erwerb des Nutzungsrechts zum Daten-Download zur Verfügung.

3. Der Verkäufer darf durch den Kunden gespeicherte Dateien, Informationen oder sonstige Daten (z.B. kundeneigene Daten) nutzen, soweit dies für die Begründung, Durchführung oder Beendigung der Geschäftsbeziehung zu dem Kunden erforderlich ist, was insbesondere auch die Anfertigung entsprechender Kopien und deren Nutzung zu Sicherungszwecken umfasst.

§ 4 Preise, Zahlungsbedingungen, Eigentumsvorbehalt und Zahlungsabwicklung

1. Alle im Onlineshop angegebenen Preise verstehen sich inklusive der gesetzlich vorgeschriebenen MwSt.

2. Der Kunde hat die Wahl zwischen den im Rahmen des Bestellvorgangs angebotenen Zahlungsarten. Wählt der Kunde das ihm angebotene Lastschriftverfahren, hat er das dazu notwendige SEPA-Lastschriftmandat zu erteilen und für ausreichende Deckung des Bankkontos bei Fälligkeit zu sorgen. Bei gegen Lastschrift ausgeführten Bestellungen erhält der Kunde in der per E-Mail übermittelten Rechnung eine Vorabankündigung (Prenotification) über die bevorstehende Belastung des Bankkontos. Die Vorabankündigung erfolgt so rechtzeitig, dass zwischen ihr und der Belastung ein Bankarbeitstag liegt. Für den Fall der Rückgabe oder Nichteinlösung einer Lastschrift ermächtigt der Kunde die Bank mit Zustandekommen des Vertrags unwiderruflich, dem Verkäufer seinen Namen nebst aktueller Anschrift mitzuteilen. Bearbeitungsgebühren für die unberechtigte Rückgabe oder Nichteinlösung einer Lastschrift, die dem Verkäufer durch die Bank des Verkäufers in Rechnung gestellt werden, sind vom Kunden zu erstatten.

3. An den Kunden im Rahmen der Versandvariante gelieferte Standardartikel bleiben bis zu ihrer vollständigen Bezahlung im Eigentum des Verkäufers. Bei einem Daten-Download erfolgt die Vergabe des Nutzungsrechts unter dem Vorbehalt der vollständigen Begleichung aller gegen den Kunden aus der Bestellung bestehenden Ansprüche.

§ 5 Nutzungsvoraussetzungen von eBooks und Audiodateien

1. Der Verkäufer verschafft dem Kunden an Pdf, eBooks und Audiodateien kein Eigentum. Der Kunde erwirbt ein einfaches, nicht übertragbares, vor vollständiger Zahlung der vereinbarten Vergütung widerrufliches Recht zur Nutzung des angebotenen Titels für den persönlichen Gebrauch.

2. Der Inhalt von Pdf, eBooks und Audiodateien darf von dem Kunden vorbehaltlich abweichender zwingender gesetzlicher Regeln weder inhaltlich noch redaktionell verändert werden.

3. Der Kunde darf Pdf, eBooks und Audiodateien nur für den eigenen persönlichen Gebrauch kopieren oder zu diesem Zweck von einem Dritten kopieren lassen, sofern der Dritte die Kopie unentgeltlich erstellt. Eine Weitergabe von Pdf, eBooks und Audiodateien an Dritte (einschließlich Freunde, Verwandte, Bekannte o.ä.) ist nur zeitweilig für den Zweck der Herstellung einer solchen Kopie gestattet; im Übrigen ist eine Weitergabe unzulässig, ebenso deren öffentliche Zugänglichmachung bzw. Weiterleitung, deren entgeltliches oder unentgeltliches Einstellen ins Internet oder in andere Netzmedien, deren Weiterverkauf und/oder jede sonstige Art von deren Nutzung zu kommerziellen Zwecken. Das Fotokopieren von Noten ist untersagt.

§ 6 Widerrufsrecht

Bei Verträgen über die Lieferung von Artikeln steht dem Kunden gegenüber dem Verkäufer folgendes Widerrufsrecht zu:

Sie haben das Recht binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag
– an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat, wenn Sie eine Ware oder mehrere Waren im Rahmen einer einheitlichen Bestellung bestellt haben und die Ware bzw. Waren einheitlich geliefert wird bzw. werden; oder
– an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die letzte Ware in Besitz genommen haben bzw. hat, wenn Sie mehrere Waren im Rahmen einer einheitlichen Bestellung bestellt haben und die Waren getrennt geliefert werden; oder
– an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die letzte Teilsendung oder das letzte Stück in Besitz genommen haben bzw. hat, wenn Sie eine Ware bestellt haben, die in mehreren Teilsendungen oder Stücken geliefert wird.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns ( mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.

Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Wir tragen die Kosten der Rücksendung der Waren.

Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

Ausschluss bzw. vorzeitiges Erlöschen des Widerrufsrechts

Das Widerrufsrecht besteht nicht bei Verträgen zur Lieferung von Waren, die – nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind oder
– schnell verderben können oder deren Verfallsdatum schnell überschritten würde. Das Widerrufsrecht erlischt vorzeitig bei Verträgen zur Lieferung von Ton- oder Videoaufnahmen oder Computersoftware in einer versiegelten Packung, wenn die Versiegelung nach der Lieferung entfernt wurde.

§ 7 Widerrufsrecht bei Daten-Downloads

Bei Verträgen über die Lieferung von Daten-Downloads (nicht auf einem körperlichen Datenträger befindlichen digitalen Inhalten) steht dem Kunden gegenüber dem Verkäufer folgendes Widerrufsrecht zu:

§ 8 Gewährleistung und Haftung des Verkäufers/ der Buchhandlung

1. Dem Kunden stehen vorbehaltlich der folgenden Absätze 2 bis 4 die gesetzlichen Gewährleistungsansprüche zu.

2. Ansprüche des Kunden auf Schadenersatz sind ausgeschlossen. Hiervon ausgenommen sind Schadenersatzansprüche des Kunden aus der Verletzung des Lebens, des Körpers, der Gesundheit oder aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) sowie die Haftung für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Verkäufers/der Buchhandlung, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertrauen darf.

3. Bei der Verletzung wesentlicher Vertragspflichten haftet der Verkäufer/die Buchhandlung nur auf den vertragstypischen, vorhersehbaren Schaden, wenn dieser einfach fahrlässig verursacht wurde, es sei denn, es handelt sich um Schadenersatzansprüche des Kunden aus einer Verletzung des Lebens, des Körpers oder der Gesundheit.

4. Die Einschränkungen der Absätze 2 und 3 gelten auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Verkäufers/der Buchhandlung, wenn Ansprüche direkt gegen diese geltend gemacht werden.

5. Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt, ebenso eventuelle Ansprüche aus einer durch den Verkäufer/die Buchhandlung oder einen Dritten übernommenen Garantie für die Beschaffenheit der Sache oder dafür, dass die Sache für eine bestimmte Dauer eine bestimmte Beschaffenheit behält.

§ 9 Datenschutz

1. Der Kunde ermächtigt den Verkäufer und die Buchhandlung, die im Zusammenhang mit der Geschäftsbeziehung erhaltenen Daten des Kunden im Sinne der Datenschutzgesetze zu verarbeiten, zu speichern, auszuwerten und zu nutzen.

2. Der Kunde hat ein Recht auf Auskunft sowie ein Recht auf Berichtigung, Sperrung und Löschung seiner gespeicherten Daten.

3. Ausführliche Informationen über Art und Umfang der Datenspeicherung persönlicher Daten erhält der Kunde unter der Rubrik “Datenschutz” (siehe auch Fußende der Webseite).

4. Zum Zwecke der Kreditprüfung wird die CRIF Bürgel GmbH, Radlkoferstraße 2, 81373 München, die in ihrer Datenbank zur Person des Kunden gespeicherten Adress- und Bonitätsdaten einschließlich solcher, die auf der Basis mathematisch-statistischer Verfahren ermittelt werden, dem Verkäufer zur Verfügung stellen, sofern der Verkäufer sein berechtigtes Interesse glaubhaft dargelegt hat. Zum Zweck der Entscheidung über die Begründung, Durchführung oder Beendigung des Vertragsverhältnisses erhebt oder verwendet der Verkäufer Wahrscheinlichkeitswerte, in deren Berechnung unter anderem Anschriftendaten einfließen.

5. Der Verkäufer nutzt die E-Mail-Adresse des Kunden, um ihm Newsletter des Verkäufers zuzusenden – sollte der Kunde diese abonniert haben – und für Informationsschreiben, die aktuelle Informationen rund um die Shop-Angebote, Dienstleistungen, Sonderangebote und Aktionen des Verkäufers enthalten. Wenn der Kunde die Newsletter oder diese Informationsschreiben nicht (mehr) erhalten möchte, kann er diese jederzeit – über einen in der entsprechenden E-Mail integrierten Link und auch per E-Mail an die Adresse ………………………… – kostenlos abbestellen.

§ 10 Sonstiges

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Unberührt davon bleiben die zwingenden Bestimmungen des Staates, in dem der Kunde seinen gewöhnlichen Aufenthalt hat. Sowohl der Verkäufer als auch die Buchhandlung sind nicht verpflichtet und nicht bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
